1. Acceptance of Terms
By downloading, installing, or using the VideoWeigh mobile application (“App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the App.
2. Description of Service
VideoWeigh is a mobile application designed for fishing competitions that provides:
- Video-based catch verification
- Weight recording and tracking
- Team coordination features
- Offline-first functionality with cloud synchronization
- Anti-fraud verification systems
3. Account Registration
3.1 Account Requirements
- You must be at least 13 years old to create an account
- You must provide accurate and complete registration information
- You are responsible for maintaining the security of your account credentials
- You must notify us immediately of any unauthorized account access
3.2 Account Responsibilities
- One person may only have one active account
- You may not share your account with others
- You are responsible for all activities under your account
4. Acceptable Use
4.1 Permitted Uses
- Participating in authorized fishing competitions
- Recording legitimate fishing catches
- Collaborating with assigned team members
- Viewing competition results and rankings
4.2 Prohibited Conduct
You agree NOT to:
- Submit fraudulent or manipulated videos
- Falsify catch weights or timestamps
- Attempt to bypass anti-fraud measures
- Use the App for any illegal activity
- Harass or abuse other users
- Reverse engineer or modify the App
- Use automated systems to interact with the App
- Violate any competition rules
5. Competition Rules
5.1 General Rules
- All catches must be recorded using the App’s video feature
- Catches must occur within the designated competition time window
- The anti-fraud token must be active when recording
- Weight must be accurately recorded as shown on the scale
5.2 Disqualification
Violations may result in:
- Disqualification from current competition
- Removal of catch records
- Temporary or permanent account suspension
- Legal action in cases of fraud
5.3 Disputes
Competition organizers have final authority on catch validity and disputes.
6. Intellectual Property
6.1 Our Property
The App, including its design, features, code, and branding, is owned by VideoWeigh and protected by intellectual property laws.
6.2 Limited License
We grant you a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes in accordance with these Terms.
6.3 Restrictions
You may not:
- Copy, modify, or distribute the App
- Use our trademarks without permission
- Create derivative works based on the App
7. User Content
7.1 Your Content
You retain ownership of videos and data you create (“User Content”).
7.2 License to Us
By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free license to:
- Store and process your content for App functionality
- Share content with competition organizers and team members
- Use anonymized data for service improvement
7.3 Content Standards
User Content must not:
- Contain illegal or harmful material
- Violate third-party rights
- Include misleading information
8. Privacy
Your use of the App is also governed by our Privacy Policy, available at https://davidandreuroqueta.github.io/videoweigh-legal/privacy-policy. By using the App, you consent to our data practices as described therein.
9. Third-Party Services
The App uses third-party services including:
- Supabase for authentication and data storage
- Cloudflare R2 for video storage
Your use of these services is subject to their respective terms and privacy policies.
10. Disclaimer of Warranties
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- MERCHANTABILITY
- FITNESS FOR A PARTICULAR PURPOSE
- NON-INFRINGEMENT
- ACCURACY OR RELIABILITY
We do not guarantee:
- Uninterrupted or error-free service
- Accuracy of competition results
- Compatibility with all devices
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- We are not liable for any indirect, incidental, special, consequential, or punitive damages
- Our total liability shall not exceed the amount you paid us in the past 12 months (if any)
- We are not responsible for:
- Lost catches or competition opportunities
- Data loss due to sync failures
- Actions of other users or competition organizers
- Device malfunctions or compatibility issues
12. Indemnification
You agree to indemnify and hold harmless VideoWeigh, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:
- Your use of the App
- Your violation of these Terms
- Your violation of any third-party rights
- Your User Content
13. Account Termination
13.1 By You
You may delete your account at any time through the App settings or by contacting us.
13.2 By Us
We may suspend or terminate your account for:
- Violation of these Terms
- Fraudulent activity
- Extended inactivity
- Legal requirements
13.3 Effect of Termination
Upon termination:
- Your access to the App will be revoked
- Your data may be deleted according to our Privacy Policy
- Provisions that should survive will remain in effect
14. Changes to Terms
We may modify these Terms at any time. Changes will be effective when posted. Continued use of the App after changes constitutes acceptance of the new Terms.
For material changes, we will:
- Notify you via email or in-app notification
- Provide at least 30 days notice before changes take effect
15. Governing Law
These Terms are governed by the laws of Spain, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Spain.
16. Dispute Resolution
Before filing any claim, you agree to contact us and attempt to resolve the dispute informally for at least 30 days.
16.2 Jurisdiction
All disputes shall be submitted to the exclusive jurisdiction of the courts of Spain.
17. General Provisions
17.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and us.
17.2 Severability
If any provision is found unenforceable, the remaining provisions will continue in effect.
17.3 Waiver
Our failure to enforce any right does not constitute a waiver of that right.
17.4 Assignment
We may assign these Terms. You may not assign your rights without our consent.
